What Is a Private Investigator? What They Can (and Cannot) Do in Louisiana

PI Basics Louisiana Law Surveillance

Private investigators occupy a unique space in the legal landscape. They are not law enforcement, but they are licensed professionals operating under strict state regulations. In Louisiana, a PI must hold a valid license issued by the Louisiana State Board of Private Investigator Examiners, and that license comes with both significant authority and clear limits.

What a Licensed Louisiana PI Can Do

A licensed PI in Louisiana is authorized to conduct a wide range of investigative activities on behalf of clients. These include:

  • Conduct covert and overt surveillance in public places
  • Perform background checks using legally accessible databases
  • Locate missing persons and conduct skip tracing
  • Serve legal process documents
  • Investigate insurance fraud and workers' compensation claims
  • Gather evidence for use in civil and criminal proceedings
  • Conduct TSCM (Technical Surveillance Countermeasures) sweeps
  • Provide executive protection and personal security
  • Interview witnesses and document statements
  • Perform corporate due diligence and risk assessments

What a PI Cannot Do

This is where television gets it wrong. Private investigators do not have police powers. They cannot arrest anyone, access private records without authorization, trespass on private property, or intercept electronic communications. Specifically, a Louisiana PI cannot:

  • Make arrests or detain individuals
  • Access sealed court records, tax records, or protected medical files
  • Tap phones or intercept electronic communications without consent
  • Trespass on private property to conduct surveillance
  • Impersonate law enforcement or government officials
  • Hack into email, social media, or computer systems

"The best investigators work within the law, not around it. Evidence gathered illegally is not only inadmissible, it can expose you and your attorney to serious legal liability."

Why Louisiana Licensing Matters

Louisiana requires all private investigators to be licensed, bonded, and insured. This protects clients by ensuring the investigator has passed background checks, met experience requirements, and understands state law. When you hire an unlicensed investigator, or try to conduct surveillance yourself, you risk evidence being thrown out of court and potential criminal exposure.

Foresight PI has been licensed in Louisiana since 1987. Every member of our team is a full-time, licensed investigator, not a contractor or part-time operative. When your case matters, that distinction is everything.
